Jurisdiction
This site is administered by the European Council
for Plasticisers and Intermediates (ECPI), from
Brussels, Belgium. As a consequence, Belgium law is
the one applicable under the principles governing
International Private Law on the choice of law.
Belgium law means: all laws applicable in Belgium,
as complemented whenever applicable by European law
and International law.
This choice of applicable law does not exclude
the application of other laws, from other
jurisdictions in a given country, or applicable to
certain actions (eg competition law).
If the site is used by the extranet participants
from other locations than Belgium, then each
extranet participant is responsible for compliance
with applicable law. By downloading or using the
content or any features from this site, extranet
participants are responsible for doing so, under the
laws applicable to the jurisdiction from which they
do so.
Competition compliance
Whenever a Cefic Sector Group like ECPI,
organises an activity, there is the potential that
problems actionable under competition may arise. It
should be clear that meetings or other activities,
like participating into this site, do not insulate
the activity from attack under competition law.
Therefore, network participants must be aware that
competition law applies to all activities relating
to this site.
ECPI serves a legitimate and useful purpose and may
legally engage in a wide variety of activities which
serve the industry, as long as these do not violate
antitrust laws.
Considerations of the various competition laws
that may possibly apply require that ECPI, its
Members and the extranet participants refrain from
any activities which might possibly be considered as
unlawful or even may given the appearance of
violation and may invite suspicion or trigger
investigations from the enforcement authorities.
